Update On The Cap Gemini Saga The negotiations between Customer Services management and Local 120 ended in October, with the signing of a joint agreement between Labor & Management, that limits the duration and scope of the Cap Gemini engagement. It also provides for replacement of at least one, and up to three Cap Gemini employees with Union members. Below is a copy of the agreement: |

Letter of Agreement This letter of agreement is between the City of Tacoma and Tacoma, Washington, City and Pierce County Employees Local Number 120 of the American Federation of State, County and Municipal Employees AFL-CIO. This letter describes agreements reached during impact bargaining resulting from the City's notification to the Union on June 1, 2000, of the City's desire to subcontract bargaining unit work, pursuant to Article 16 of the current collective bargaining agreement. This agreement satisfies the obligation to negotiate the impacts of the adoption of the contract and no further negotiations will be required. Customer Service management anticipates that the number of ADSA's (Application Development Systems Analyst) added during the Cap Gemini agreement will be maintained throughout the duration of the Cap Gemini agreement and its possible extensions. The proposed Cap Gemini contract does not include implementation or maintenance of the new CIS system. City of Tacoma and Local 120 agree to work with the vendor under a multi-year agreement with Cap Gemini Ernst & Young U.S. (Cap Gemini) for maintenance and enhancement to the existing Customer Information System, with the following provisions: 1) The duration of the proposed Cap Gemini contract is for two (2)
years minimum, with two (2) possible one-year extensions. It is agreed Cap
Gemini's services will terminate no later than the date the current CIS
system is switched off. 2) The work performed by Cap Gemini on Tacoma's CIS software and associated systems will be performed here in Tacoma, rather than at Cap Gemini's New York headquarters. Cap Gemini staff working here in Tacoma may utilize resources including Cap Gemini technical experts and City staff other than those specifically assigned to this project. 3) Cap Gemini's proposal anticipates the following staffing levels
although Cap Gemini may assign additional resources as may be needed to
meet its service commitments: 4) The following City employees will work in Customer Service and
perform work with Cap Gemini and/ or the new CIS, as the needs and
opportunities may be: 5) Effective within 30 days of signing the proposed Cap Gemini agreement, The City will post the Senior Technical ADSA position for internal transfer. This posting will specify that this is an opportunity to work with Cap Gemini, specify the proficient programming language skills expected, and express Cap Gemini's expectation that the employee have a commitment to remaining with the project for two years. The Customer Service Manager will select the employee based on information provided by a panel including a representative from Cap Gemini and a representative identified by the Union. The employee will be subject to the same types of performance measures as other City employees and Cap Gemini employees. Employees would be subject to probationary status as set forth in the Personnel Rules. 6) When a CIS replacement vendor is selected, which is anticipated to be in 2001, Customer Service's IT staffing requirements will be evaluated by TPU management. 7) Possibly as early as mid year 2001 but not later than January 1, 2002, an ADSA or Sr. ADSA will be hired, who may replace another Cap Gemini employee or be assigned to new CIS system work. Cap Gemini desires that any City employee replacing a Cap Gemini employee commit to remain with the project two years or until the conclusion of the agreement. If an employee replaces a Cap Gemini employee, Cap Gemini employees remaining on site would include the Project Manager and between two and three Programmers and/or Business Analysts. 8) Possibly as early as mid year 2002 but not later than January 1, 2003, an ADSA or Sr. ADSA will be hired, who may replace another Cap Gemini employee or be assigned to new CIS system work. If an employee replaces a Cap Gemini employee, Cap Gemini employees remaining on site would include the Project Manager and from one to three Programmers and/or Business Analysts. 9) While work will be managed by Cap Gemini's project manager, the supervisor of the Customer Services Division IT employees, including Computer Systems Programmers and Computer Systems Technicians, will be the Customer Services Department's Administrative Services Manager. 10) Current and new City employees will receive training that is consistent with their work assignments or requirements generated by the new CIS system. This Letter of Agreement is entered into by the parties to allow for
current CIS system operation. It is not intended to set any precedent for
departments, divisions, employees or unions. This letter will not change
the rights of either party with respect to contracting out or outsourcing
of bargaining unit work. |
